RESERVATIONS TERMS & CONDITIONS

This 'Online Reservations Service' is operated and managed by 'Border Midland & Western Hotels', t/a Breffni Technologies, Tievenaman, Virginia, Co. Cavan, Ireland. The terms listed below set out the rights and obligations of the User ("You") and those of 'Breffni Technologies' ("BMW Hotels") and the Accommodation Provider ("the Provider") in relation to the services offered.

All Users are strongly advised to carefully read the following conditions of use before clicking on the "Continue" button during the reservation process. By clicking on the "Continue" button you are confirming your Accommodation Reservation with the Provider hence creating a binding agreement between You and the Provider.

• When You make an online accommodation reservation You must:

o Enter correct contact details
o Pay a deposit of between 4% and 10%
o Use a valid credit or laser card to guarantee the accommodation reservation
o Be responsible for the payment of the balance due (between 90% and 96%) and any additional costs to the provider upon arrival/departure
o Read the cancellation policy (See Cancellations). (You hereby confirm that You have read and understand the cancellation requirements when you make your accommodation reservation.)
o Check and confirm all reservation details within 24hrs of the date/time which appears on your booking confirmation receipt. After 24hrs the Provider will deem the booking to be confirmed and all terms and conditions will apply.

• Where You request special facilities or additional requirements that You must ensure that the accommodation of your choice has them available.
• BMW Hotels reserves Accommodation on behalf of and with the authority of the person mentioned on the Reservation Form as the Provider and You.
• Rates or prices quoted will not include additional requirements unless specifically stated. While every effort has been made to ensure accuracy of information BMW Hotels accepts no responsibility for errors or omissions in the provision of information, nor accepts any liability for loss, injury, damage, delay, expense or inconvenience whatsoever in relation to the provision of the information.
• The Provider shall be solely liable to You for any loss that You may suffer in connection with the accommodation reservation. If the Accommodation that You reserved is not available, it is the Provider's responsibility to ensure that suitable equivalent Accommodation of a similar or higher standard is arranged for You and that transport is arranged to such alternative Accommodation.
• The liability of the Provider shall not exceed the total price for the Accommodation as specified on the Reservation Form. In no event will the Provider be liable for any indirect or consequential loss by You. You agree to indemnify and hold harmless the Provider against all costs or damages whether direct or indirect arising from any acts or omissions by You.

Cancellations

If you wish to cancel or amend a reservation you can do so either by contacting BMW Hotels or contacting the Provider directly. Always quote the Reservation ID Number on your Booking Confirmation Receipt when contacting BMW Hotels.

Please note that the following cancellation terms apply:

All online bookings are subject to a non-refundable booking deposit with few exceptions. If you feel your circumstances justify a deposit refund please apply to us in writing stating the reasons why to; Border Midland & Western Hotels, Tievenaman, Virginia, Co. Cavan, Ireland or (by email) to; info@bmw-hotels.com. If you cancel within 48 hours of your arrival time, you will also lose the cost of the first night's accommodation. This will be charged to your credit/laser card as outlined to you in our Conditions of Use.

The Reservation ID Number on your Booking Confirmation Receipt should be quoted in all enquiries, cancellations or modifications of your reservation.

Privacy Policy

We at BMW Hotels respect your right to privacy and will comply with our obligations under the Data Protection Acts 1988 and 2002. The purpose of this policy is to outline how we deal with any personal data you provide to us while visiting our web site because by visiting this web site, you are accepting the terms of this policy. We are not responsible for the content or privacy policies of any other web sites You may access through our website.

Disclosure of Information to Third Parties

BMW Hotels will never disclose any personal information to third parties

Updating and Deleting of Personal Data

You may inform BMW Hotels of any changes to your personal data and as obliged to under the Data Protection Acts 1988 and 2002, BMW Hotels will update or delete your information accordingly.

Changes To The Policy

You should understand that this policy may change from time to time to reflect legal or technical requirements. Any changes will be posted onto this website so You will always be aware of what information is collected and how it is used.

CAREFULLY READ THE FOLLOWING TERMS & CONDITIONS (“THE AGREEMENT”) WHICH GOVERNS THE USE BY (“YOU”) OF THE BMW HOTELS SERVICE.

BMW Hotels service (“the Site”) is an Online Accommodation Reservation Service that provides You with the facility to reserve accommodation online. The Service is operated and managed by Breffni Technologies.

This agreement represents the entire agreement between BMW Hotels and You relating to the site and supersedes any and all prior promises, representations, agreements, statements and understandings whatsoever which existed or may have existed between BMW Hotels and You. BMW Hotels may modify the agreement upon notice published on the Site. BMW Hotels reserves the right to suspend, modify or amend the Site (or any part thereof) from time to time.

You may only use the Site to make legitimate enquiries or reservations and hereby undertake not to make any speculative, false or fraudulent reservations or any reservations in anticipation of demand.

Intellectual Property Rights

You acknowledge the copyright, trademarks and all other intellectual property rights in relating to the site are and shall remain the property of BMW Hotels and the Accommodation Providers.

You shall not copy, market, re-sell, distribute, retransmit, publish or otherwise transfer or commercially exploit in any form the Site.

Except to the extent permitted by law, You shall not reverse engineer, decompile, disassemble, alter or modify the whole or any part of any software, which is accessible via or in connection with the Site. You shall not access the Site by any means, or in any sequence, other than those provided on-line as part of its normal user interface.

You will not use or display the name or logo of BMW Hotels or its domain name www.bmw-hotels.com or any similar name or logo or act in any way that would imply that You are an agent of BMW Hotels.

Liability

BMW Hotels and the Accommodation Providers have taken reasonable care to ensure that the content of the Site including all Accommodation information and listings are accurate. The Accommodation information is compiled from information supplied by the Accommodation Providers and BMW Hotels publish this information in good faith. You acknowledge and accept that BMW Hotels cannot be held responsible for any inaccuracies in such information, nor can liability be accepted for changes to facilities which are not notified to BMW Hotels by the Accommodation Provider in question.

Clicking on certain links on the Site will take You to other third party sites and BMW Hotels shall have no responsibility or liability of any kind for the accuracy or content of any information or any other aspect of any such third party sites.

BMW Hotels shall under no circumstances be liable to You in respect of any claim by You for indirect or consequential loss or damage (including loss of profits or goodwill) whether or not caused through negligence, relating to the Site or other information provided as part of the Site, or its use by You. BMW Hotels shall not be liable and shall not otherwise be deemed to be in breach of this Agreement, for any failure to perform (or delay in performing) any of its obligations hereunder caused by circumstances beyond its reasonable control.

Termination

Without prejudice to any other rights or remedies, BMW Hotels may at any time suspend the Site or terminate the Licence forthwith if You are in material breach of any of its obligations under the Agreement.

Governing Law and Disputes

This Agreement shall be governed by and construed in accordance with the laws of Ireland (excluding laws governing the conflict of laws) and BMW Hotels and You submit to the jurisdiction of the Irish Courts. This will not prevent BMW Hotels from pursuing a claim for breach of contract, copyright infringement or otherwise in respect of this Agreement.
